My step father had empty beer cans in his vehicle and pot in his glove compartment. Here is where it gets tricky. She was on probation and her license were revoked. She got scared and told the police she was aunt and of course they found out she was not. Her charges are drug paraphernalia, possession of drug, open container, falsification, probation violation and driving under suspension. All are misdemeanors. My question is, is there any way possible I can assist her in this matter. How would I be able to get those dropped and would I be cable to get her released from jail on house arrest?

Re: Acting as Your Own Lawyer – Practical Tips for Representing Yourself in a Court of Law: Part I

I think this is great advice. Unfortunately, my attorney dropped the case when he realized he had failed to even look at it after two and 1/2 years and the case is in New Mexico. I've been trying for a month to find an attorney--there is even a videotape of my fall and injury! I can't even convince an attorney to call me back. Sometimes, there are absolutely no options.

Re: Acting as Your Own Lawyer – Practical Tips for Representing Yourself in a Court of Law: Part I

http://www.thenewcivilright...

Re: Acting as Your Own Lawyer – Practical Tips for Representing Yourself in a Court of Law: Part I

MARK TRAINA vs. LAKEVIEW REGIONAL MEDICAL CENTER and ICU NURSE RAY JENNINGS

What happens when those we hire to HELP U.S., HURT U.S.?

This is my story:

To: LOUISIANA PATIENT COMPENSATION PANEL – Fax: 225-342-1057

From: Mark Anthony Traina
I am seeking compensation for mental anguish, pain and suffering, post-traumatic stress, medical malpractice, past, present and future medical expenses, as well as, loss of income over the past year and loss of income in the future!

My name Mark Anthony Traina – Patient

I seek medical malpractice compensation from the Lakeview Regional Medical Center LLC and
ICU Nurse Ray Jennings - Plaintiffs

Dates of malpractice: 04-27-2015 and 04-28-2015

I underwent OPEN HEART SURGERY at LAKEVIEW REGIONAL HOSPITAL on 04-27-2015; 2-hours after surgery I woke up in the ICU at 12:30 AM on 04-28-2015, with Nurse Ray Jennings telling me to “MAN UP”, “STOP ACTING LIKE A LITTLE GIRL” and him telling me, “WHAT DID YOU EXPECT, YOU JUST HAD OPEN HEART SURGERY”! Needless to say I was intubated during that time period and was unable to respond to Nurse Jennings verbal taunts! My right shoulder had been severely injured at some point in pre-opt, or the surgical procedure, and Nurse Jennings refused to provide me with a pen and paper so that I could write down exactly what was ailing me; specifically my right shoulder! Nurse Jennings response to me was, “I AM NOT GOING THERE WITH YOU”, as he walked out of my ICU room, he said, and I quote, “I AM OFF TO SAVE MORE LIVES”! After the breathing tubes were removed from my mouth, the first words out of my mouth were, “YOU HAVE NO IDEA WHO YOU ARE FUCKING WITH”! Nurse Ray Jennings response to me in front of the Nurse assisting him in removing the breathing tubes was, “I REALLY DON’T GIVE A SHIT”! I begged Nurse Jennings to call my Wife, but he refused, telling me “I AM NOT GOING TO INCONVIENCE YOUR WIFE AT 3:30 AM”! Fortunately for me another nurse heard my repeated pleas for my Wife and came into my ICU Room and told Nurse Jennings, “EITHER YOU ARE GOING TO CALL MR. TRAINA’s WIFE OR I AM”. Nurse Ray Jennings response to the Nurse was, “HE IS MY PATIENT AND I’LL DO WHATEVER I WANT”! Moments later I could hear Nurse Jennings standing in my door way talking to my Wife on the phone an asking her whether or not I was easily agitated. He then assured her that I was doing fine, and that she should get some rest and return to the Hospital later in the morning. A few moments after Nurse Jennings got off the phone with my Wife, the nurse who assisted him in removing my breathing tubes came up and said, I have called your Daughter’s Phone and have her Voice Messaging Recording on if you would like to leave her a message. I spoke into the phone saying, “PLEASE COME BOBBEE, PLEASE COME, I AM SCARED OF THIS NURSE AND I FEEL LIKE I’M DYING”! An hour later my Wife and Daughter arrived at the Hospital. The first thing that my Daughter said to me was, “WHAT CAN I DO TO MAKE YOU FEEL MORE CONFORTABLE?” I said, “MY RIGHT SHOULDER IS KILLING ME, DO YOU THINK THAT YOU CAN FIND ME A PILLOW TO RAISE IT UP A BIT”, it took 4 small pillows to ease the pain! I also asked Nurse Jennings if I could have something for pain, his response was, “I HAVE GIVEN YOU ALL I CAN, I HOPE YOU DON’T THINK THAT THEY ARE GOING TO GIVE YOU PAIN MEDICINE ALL THE TIME BECAUSE THEY ARE NOT, YOU WOULD NEVER WANT TO GET UP OUT OF THE BED IF THEY DID”! During that time period Nurse Jennings was standing in the door way telling my Wife, “I HAVE CARED FOR MANY PATIENTS OVER THE PAST 20-YEARS, MOST OF THEM WERE ABLE TO GO HOME IN FOUR TO FIVE DAYS, BUT I DON’T SEE THIS HAPPENING WITH HIM” My Wife asked him why and he said, “HE IS NOT COOPERATIVE”! My daughter heard Nurse Jennings telling his Replacement Nurse, “GOOD LUCK WITH THAT ONE”! Before Nurse Jennings left he came into my room and said to me, “I AM SORRY IF I WAS A MEAN NURSE, BUT WHEN I LEAVE HERE I WILL BE TAKING YOU WITH ME”! He also told me in front of my Wife that he could attach the Pulse Meter Line to the bottom of my ear lobe, saying “BUT THAT WOULD MAKE YOU LOOK LIKE A LITTLE GIRL”! Nurse Jennings then shook my hand and left for the day! I must say that I was never so happy to see anyone leave in my whole life. During my stay in the LRMC, I reported this incident to my Heart Doctor Martha Carr (985) 871-8227, my Heart Surgeon Dr. Gregory Groglio (985)-726-0026 Director of the ICU Peggy Verlander and LRMC Chief Executive Officer Bret Kolman (985) 867-3800.

I know that what Nurse Ray Jennings did to me hindered my recovery and has caused me a great deal of pain and suffering. It is a miracle that I did not go into cardiac arrest during the time I was under his care. Since Surgery three of my bypasses have collapsed, and on three separate occasions, I’ve had to have stents installed to open up my clogged arteries. I also suffered a Splenic Infarction on 07-13-2015. My Wife rushed me to Slidell Urgent Care where the Staff Physician diagnosed me and sent me to Slidell Memorial Hospital for treatment. I stayed until 07-18-2015. I am currently being treated psycho tropically for depression, mood swings, suicidal ideations, a sleep disturbance and a post-traumatic stress disorder.
A formal complaint against ICU Nurse Ray Jennings was filed with LRMC HOSPITAL ADMINISTRATORS on 05-08-2015, and an internal hospital investigation was allegedly ensued. It should be noted that no one at the LRMC ever interviewed me or any of my family members, but they did tell me that they had reported this incident to the LOUISIANA DEPARTMENT of HEALTH and HOSPITALS. I also reported this incident to the LOUISIANA STATE BOARD of NURSING on 05-08-2015, the Investigator assigned to my case is Theresa Lockhart, and she can be reached at 225-755-7570.
FACT: We cannot allow Medical Care Providers to treat Patients with such callousness in the State of Louisiana. Callousness on the part of a highly trained medical professional that caused me long-term pain and suffering, as well as, a horrific medical procedural outcome.

Mark Anthony Traina
Slidell, Louisiana 70458
(504) 231-3056
Fatuouscra@aol.com

LOUISIANA MEDICAL REVIEW PANELS: Are they "FAIR & BALANCED"?

About 1,600 Louisiana patients per year ask medical review panels to examine their malpractice complaints. Compare that with 23,000 licensed health care providers who are entitled to medical review panels, and the rate of complaints lodged against all medical professionals is almost 7 percent.

Medical review panels are three-person boards assembled to determine whether there is merit to a patient's complaint. It's a mandated precursor to filing a malpractice lawsuit in court. State law requires the panels to be staffed with physicians who have expertise in the area of medicine in question.

The panel's role is to determine whether there was indeed a breach in the standard of care provided to the patient. Though the panel's decision is not binding, its findings can hold evidentiary value as the case goes to court. The panels have sided with patients only 7 percent of the time since 2000, and the percentage is even smaller than that in recent years.

http://i.imgur.com/YctPD2Y.jpg

DOCTORS on MEDICAL REVIEW PANELS judging the PRACTICES of other MEDICAL PROFESSIONALS, and the HOSPITALS that EMPLOY THEM, is exactly like HIRING the FOX to GUARD the HEN HOUSE!

Re: Acting as Your Own Lawyer – Practical Tips for Representing Yourself in a Court of Law: Part I

Thinking of going pro se on a paraphernalia case. I have an Auto Fraud case. In my City there are no Auto Fraud Attorneys. I went out of state and talked with an Attorney . He told me I had a good case and the papers I have to prove it was like Gold. Then all of a sudden he says that the dealership says they are right and that they will fight all the way which is fine with me because they fraud ed me. But this attorney is something else all of a sudden he started avoiding me having his secateries make up excuses and such about talking with me. So I called today and another excuse so I secluded an appointment with him. The SECETARY made the appointment for tomorrow at 3:00 . Then 10 minutes later she calls me back and tells me that a letter has been sent to me in the mail and I haven't received it because of the holidays . Today is a holiday Martin Luther birthday. So I tell her ok and she said well the letter says that the Attorneys for the Dealership say they will fight all the way. I said ok that's fine with me. She then said well the Attorney said he will need $2,500.00 up front and $185.00 per. hour. Mind you this is an Attorney that doesn't get paid till you do. I feel as though the dealerships firm is too strong for this Attorney. Well also I had told him a fewon the back because that's how long he has kept me hanging that I heard he was a good Attorney. He told me don't believe everything you hear then laughed. I said to him oh I'm worried now. He laughed and said aw It will be ok. I have a open and shut case . I was fraud ed by a Dealership and I need an Attorney that will not be scared of their law firm. I am just frustrated. I need help.

Re: Acting as Your Own Lawyer – Practical Tips for Representing Yourself in a Court of Law: Part I

Need cases in NYC where lawyers have been sued by other lawyers or their Clients. In this case, it could very well have been legal. In fact, it sounds like no laws at all would have been broken if you had "got a beer" for your son since you would have been the one getting it. While I do not agree that serving underage children alcohol is a smart idea, I do not agree that the moral of the story is accurate either since not drinking does not teach dangers of excessive alcohol consumption.

Re: Acting as Your Own Lawyer – Practical Tips for Representing Yourself in a Court of Law: Part I

Hi,

I have a general question... ANY advice would be greatly appreciated.

Re: Recreational Immunity and The Trampoline?

I live in a trailer park where I pay lot rent and taxes on my home, it is my job for all the up keep on the trailer I am buying, and grounds on which it sets.
